PEUAT: where can a hotel still open in Barcelona?

A building perfectly suited to a hotel may be refused a licence simply because of its PEUAT zone. We explain how the plan works and what it means for investors.

PEUAT determines licensing before the project economics

Before calculating the return on a hotel project in Barcelona, one question comes first: is new tourist accommodation allowed in this zone at all? The answer comes from PEUAT (Pla Especial Urbanístic d'Allotjaments Turístics), the special urban plan regulating hotels, tourist apartments, tourist dwellings and student residences throughout the municipality, except areas such as Collserola and non-developable land. The plan covers all forms of tourist accommodation together, not just conventional hotels. This matters when considering conversion into any accommodation format rather than a hotel in the narrow sense.

The zoning principle: from saturation to prohibition

PEUAT divides the city into zones according to how saturated each area already is with tourist accommodation. Zone 1 is the most saturated: new tourist establishments and extensions to existing ones are not permitted there. This is not a floor-area or building-type restriction. It prohibits new accommodation regardless of how attractive the property or transaction might be. Other PEUAT zones allow new accommodation subject to various conditions, but the principle is consistent: the more saturated an area, the less scope there is for a new project.

The current version of the plan

The current PEUAT revision was finally approved on 23 December 2021 and entered into force on 26 January 2022. The previous 2017 version was annulled by the High Court of Justice of Catalonia, while the 2021 version was adopted with substantially similar content. For investors, this means the plan is an established regulatory framework that has operated for several years rather than a temporary measure. The fact that an earlier version was annulled and then largely reproduced shows that the restrictive approach is persistent, rather than an isolated administrative decision.

What this means for DNPI’s hotel strategy

Checking the PEUAT zone of the target building or plot comes before any other hotel transaction analysis. A building ideally suited to hotel conversion in layout, location and condition will not obtain a new licence if it is in Zone 1, regardless of the rest of the transaction’s economics. This check sits alongside the building’s heritage status: in the historic centre, heritage protection adds another consideration to PEUAT zoning. The practical sequence

For a hotel investment strategy, the correct sequence is: first the PEUAT zone, then heritage status, and only then returns, conversion costs and the operating model. Reversing this order is a common mistake: an investor finds a building, falls in love with it, and later discovers that licensing is impossible in principle. Checking the zone takes little time and removes this particular zoning risk at an early stage.

Questions and answers

Can an exception to the ban on new hotels in PEUAT Zone 1 be obtained?

Under the current plan, Zone 1 permits neither new tourist establishments nor extensions to existing ones. The plan does not provide case-by-case exceptions based on the quality of a property or project.

Does PEUAT apply throughout Barcelona?

Almost throughout: it covers the municipality except certain areas, such as Collserola and non-developable land.

Why was the 2017 PEUAT version annulled?

It was annulled by the High Court of Justice of Catalonia. The current version was approved in December 2021 and entered into force in January 2022 with content substantially similar to the annulled version.
