First-occupation permission and the cédula: what is the difference?
Municipal first occupation and the Generalitat cédula serve different purposes. Check the documents, competent authority and validity before buying.
Two documents and different responsibilities
A cédula de habitabilidad confirms that a dwelling meets minimum habitability conditions. In Catalonia it is issued by Agència de l'Habitatge de Catalunya. First-occupation applications go through Tràmits Gencat, not Barcelona City Council's virtual office.
The municipal first-occupation procedure concerns completion and use of a building following works. Barcelona uses a comunicació de primera ocupació for major-works files. It is not limited to new buildings: the municipal rules also cover buildings following gran rehabilitación. Check the applicable procedure against the specific works permission and scope.
Documents to request before buying
- A valid cédula, including its number, address, category, issue date and expiry.
- For new construction or rehabilitation, the municipal first-occupation documentation corresponding to the completed works.
- The final works and habitability certificate where required for the relevant cédula category.
- If the seller claims an exemption from handing over a cédula, documentary grounds for professional review rather than a verbal explanation.
One document does not replace the other. Renovation alone does not determine the cédula category: the nature and legal processing of the works matter.
