Cédula de habitabilidad: you cannot let without it

The cédula confirms that a home is fit to live in. Without a valid one, letting a property in Catalonia is formally impossible; selling it is possible with conditions, and getting a new cédula takes time.

The cédula de habitabilidad is a Catalan certificate confirming that a home is fit to live in. Without a valid cédula, a flat in Catalonia cannot be let, full stop, no exceptions. It cannot be sold without one through the ordinary route either, but the law allows an exception for second-hand sales: the buyer can expressly release the seller from providing it, for example when buying the property to renovate. It is issued for 15 years. If a property has no cédula, or its cédula has expired, you can still buy it in that case, but you will need one before letting it regardless, and you have to allow time for that.

What the document certifies

The cédula certifies that a dwelling meets the minimum conditions for habitation: floor area, natural light, ventilation and basic building services. By law, notaries and estate agents must ask for proof of a valid cédula when a deal is formalised. The exception is a second-hand sale, where the buyer releases the seller from this requirement in writing, backed by a technical report certifying that the property will be able to obtain the cédula after renovation (Llei 18/2007, art. 132; Decret 141/2012).

Validity and renewal

The cédula is valid for 15 years. An expired one is a common finding in due diligence on older properties in central Barcelona: owners go years without renewing it if they have no plans to sell or let.

What if the property has no cédula

A missing or expired cédula does not block the purchase, especially if the parties agree the seller's release in advance. But letting the property needs the document with no exception: a technician inspects the property and files the application. For properties within the city of Barcelona, this goes through the Consorci de l'Habitatge de Barcelona; for the rest of Catalonia, through the Agència de l'Habitatge de Catalunya. This step has to be planned in advance, especially if you are buying to let the property as soon as the renovation is finished.

Questions and answers

Is the cédula de habitabilidad the same as the energy performance certificate?

No. The cédula confirms that a dwelling is fit to live in on basic technical criteria; the certificado de eficiencia energética rates the building's energy efficiency. A deal may need both, but each is obtained separately.

Can a flat be sold without a valid cédula?

In a second-hand sale, yes, if the buyer expressly releases the seller from this requirement and there is a technical report certifying the property will be able to obtain the cédula after renovation. Without that release, notaries and estate agents must require the valid document, and in practice most sellers renew it before listing the property.
