Estate agent fees when buying in Barcelona: who pays?
In Spain the seller has traditionally paid the agency's commission, but more and more Barcelona agencies also charge the buyer. Here is how it works in practice.
When you buy property in Barcelona, the agency's commission has traditionally been paid by the seller, and it is usually already built into the price the buyer sees. But some Barcelona agencies also charge the buyer a fee, and a buyer who hires an agent of their own pays that agent separately. The size of the commission depends on the property and the agency; there is no single figure that applies to every deal.
Who usually pays
In the Spanish property market, the agency commission has traditionally been paid by the seller. It is normally already part of the deal structure rather than added on top of the price the buyer sees. Some other markets work differently: there, a buyer's commission is a standard cost in its own right.
How much agencies charge
There is no rate set by law. Commissions vary widely with the type of property, the region and the agency, so no general figure holds for every deal. Check the range and terms for the specific listing and agency; averages found online are a poor guide here.
When the buyer pays commission too
If a buyer separately hires their own agent to find a property and see the purchase through (a buyer's agent), they usually pay that agent directly under a separate agreement. This does not affect the commission the seller pays their own agent. For an investor buying remotely, a buyer's agent can earn their fee through the time they save: you do not have to be there in person at every stage.
The second case is when the seller's agency also charges the buyer. In Barcelona the practice is growing, the newspaper Ara reported in 2024. Lawyers quoted by the paper say such a fee can only be claimed under a contract that states clearly it is payment for the agency's mediation; a line on a viewing sheet (hoja de visita) is not enough. So before the first viewing, ask the agency whether it charges buyers and how much.

Questions and answers
Is IVA charged on an estate agent's commission?
Yes. Estate agency services in Spain are subject to IVA (VAT) at the standard rate of 21%. When comparing offers from different agencies, look at the total including IVA.
What if the deal is done directly, with no agents on either side?
Then there is simply no commission. But you will have to organise all the legal and technical checks on the deal yourself, and with a complex property that raises the risk.
